
High Court judge Justice Sylvia Chiraw Mugumba will not testify in the case of Ivy Kombo Kasi and her husband Admir Kasi, the judge has ruled.
The state wanted Justice Chiraw Mugumba, who is the chair of the Legal Education Council, to confirm in court whether she wrote the letter that allowed the couple to be exempt from writing conversion exams before practicing law in Zimbabwe.
“According to Section 232 of the Code of Criminal Procedure and Evidence, it is the court that has the power to summon the witness it designates at any time,” Justice Chakanyuka said. The law must be given its ordinary meaning, consistent with the text when read in its entirety.
“As such, the words must be taken in context and it is the duty of this court to interpret the law in this case.”
