A Harare couple appeared in court yesterday facing charges of defrauding the owner of the Pandhari Hotel out of US$90,000.
Osidia Zwaniti and his wife Edzai Arovaniti appeared before Harare magistrate Ethel Chichira.
They are represented by Shepherd Makonde.
The complainant is Sunday Chifamba, owner of Pandhari Hotel. Prosecutor Zebediah Poffo told the court that in 2014, the couple made plans To defraud Chifamba by pretending to be shareholders of Anglovaal Investments Private Limited.
They allegedly also claimed to own Stand No. 761 Glen Lorne Township of 41 Glen Lorne held under Conveyance Deed 9391/98 through the company.
In March 2014, Chifamba acted on the defendant’s misrepresentation and purchased Suite 761 Glen Lorne for US$90,000 from them.
The value of the property is alleged to be equivalent to 200 shares in Anglovaal Investments (Pvt) Ltd.
In 2016, Eelco Alexis Walraven, the owner of the property who sold it to Anglovaal Investments in 2011 but later repossessed it after Anglovaal Investments (Pvt) Ltd failed to pay the full purchase price, approached Chifamba, demanding ownership of the property.
In June 2019, Walraven obtained a High Court order to evict Chivamba from the property.
As a result of the accused’s actions, the complainant suffered actual damage of US$90,000 and nothing was recovered. Newsday
