Tonderai Chipunza from Harare bought the car from a car dealership in Harare and paid a deposit of US$3,500.
He agreed to the terms with the agency and said that he would not come and receive the car’s registration book until he finished paying for the car.

Two years ago, the car owners took their case to the Supreme Court and an order was issued on August 30, 2023.
In accordance with the ruling, the Supreme Court ruled as follows:
a) The cancellation of the sales agreement between the plaintiff and the defendant is confirmed.
b) The defendant is hereby ordered to immediately return the vehicle owned by the plaintiff, namely a Mercedes Benz with registration number AFP9303, to the plaintiff.
c) The Sheriff or his legal representative is hereby ordered to take the vehicle mentioned in (b) above into his possession and deliver it to the Plaintiff in the event that the Defendant fails to return the vehicle to the Plaintiff within 24 hours from the date this order is granted.
d) The plaintiff must pay the defendant the amount of US$3,500 payable at the prevailing interbank interest rate on the day The date of payment paid by the defendant as a deposit for the vehicle upon delivery of the vehicle by the defendant or delivery of the vehicle by the sheriff in accordance with the provisions of paragraph (c) above.
