SUSPECT USED DEEDS OFFICE GIRLFRIEND newsdzeZimbabweNewsdzeZimbabwe

The prime suspect in the forgery of former minister’s title deeds, Dzingai Mutombuka, used his alleged girlfriend, Lena Mlambo, a records supervisor at the Deeds Office, to retrieve and obtain the document for a week before returning it, according to state evidence presented before Judge Ethel. Shishira yesterday.

The title deeds to Chispite’s $600,000 home in Harare have been returned, after the document was changed in the new owner’s false name, the state says. However, Mlambo became combative yesterday when she retracted the statement made by police and said she had never met the suspects.

This forced prosecutor Zebediah Boffo to apply to the judge to declare Mlambo, a state witness, a hostile witness. Judge Chishira adjourned the case until Monday to issue her ruling on the application.

The State’s case is that Mlambo colluded on 22 June 2021 with her boyfriend Tatenda “Shaft” Wakatama and two others Prosper Beswick and Jonah Njoom who remains at large to forge Mutombuka title deed 4480/88. They forged the bond in Ngomi’s name. The state says Mlambo in a caution and caution statement recorded by Detective Constable Tafadzwa Marashi stated that she was Wakatama’s girlfriend. She went on to state that she had already withdrawn the Mutombuka deed and given it to her boyfriend. She further noted that Wakatama spent a week with the instrument before returning it.

State Prosecutor Kudzanai Mudzamiri had to request an adjournment and bring in Bovo to assist her with the application in accordance with Section 316 of the Criminal Procedure and Evidence Act Cap 907. Mutombuka, Zimbabwe’s first Minister of Education, now resides in the United States. He is represented by Dzikamai Munyaradze Danha, who has power of attorney. After forging the document, the trio declared the house and sold it to Harrison Marang and his wife, Demetria Zieringa, for only US$140,000. They paid just $45,000, got the title deeds and have occupied the house ever since.

The sales agreement was prepared by lawyer Kenyas Mutiasira. When Mutombuka learned of the deal, he reported the matter to the police which led to the arrest of Wakatama and Beswick in October 2021. The case has continued since then and the Registrar of Deeds is one of the witnesses and will testify that the house belongs to him. Mutombuka and indeed the title deed was forged.
