Bulawayo nightclub owner Robert Gray Moyo was evicted at the weekend from the premises where he ran a bar in Badonhurst Shopping Center for failing to pay US$25,000 in rents owed over six years.

He is also accused of issuing a “fake” court order to illegally prolong his stay at his rented premises.

Moyo used to run a nightclub called Metropolis Bar in Ascot Shopping Center where he left under unclear circumstances a few years ago.

The businessman was kicked out of Paddonhurst Shopping Center twice, but keeps returning without permission from the owners of the building – C & D Property Investments.

Spokesperson for the family that owns the property, Ms Christabel Gamba, said Moyo through his company, Jaspro Enterprises, was illegally occupying part of the building.

“The resident (Moyo) has been running his bar without a lease, which is a self-imposed rental agreement that we, the owners of the building, did not sign. He has not paid rent for the past six years and owes more than $25,000,” she said.

“Every time we evict him, he comes back to occupy the building illegally. He has to do the right thing and learn to live with the landlords and pay his rent. We hope this time he will be a gentleman and move away from the building because he is no longer welcome here.”

The Chronicle News Crew observed a group of men hired by the building’s owners removing chairs, pool tables, boxes filled with a variety of beers, bar stools and refrigerators from the building while Moyo stood motionless.

After making several phone calls, Moyo produced what he claimed were court documents.

According to the papers, the two parties reportedly agreed to extend the lease, giving the bar owner the right to continue operating for the next two years.

“The applicant is the tenant of the building with a valid lease granted to him by the respondent represented by E.M. Gamba on 10 November 2017.

The lease was duly renewed through the representatives of the respondent, Bankables Real Estate on April 17, 2021, and I attach hereto the Notice of Renewal,” read the document.

“The applicant owns the property, operates it as a pub and grill, and has been doing so since 2017. On 17 January 2024, the respondent locked the applicant’s premises without any warning or justifiable reason, and also welded iron bars at the entrance to the building.”

The lawyer representing the building owners, Mr Arkisay James Dhluwayo of law firm T Hara and Partners, has questioned the authenticity of the court documents provided by Moyo, arguing that they are not genuine.

“At first glance, the documents presented by Moyo appear to be genuine, but in fact they are fake because the name of the judge who supposedly heard the case does not appear in the documents,” Dhliwayo said.

“I strongly believe it is not real. The lease attached to his documents expired long ago and was never renewed.

Mr Dhliwayo said Moyo had failed to adhere to the terms of the first rental agreement by not paying rent.

He added, “The building’s owners made the decision not to renew the lease and asked him to vacate the building.”
