US$1M PROPERTIES : LAWYER UNDER FIRE newsdzeZimbabweNewsdzeZimbabwe

The Law Society of Zimbabwe is reeling from an influx of clients who have allegedly been biased by a Bulawayo lawyer in several transactions involving properties worth nearly US$1 million.

Clients who spoke to The Mirror in interviews criticized the Law Society for not acting despite numerous complaints.

According to documents in the hands of The Mirror, Doreen Vundhla Phulu, Senior Partner at Vhundhla Phulu and Partners, was employed by various clients in the field of conveyancing and other legal services who later lost their property and money through alleged fraud, misuse of funds, Negligence, misinformation, and abuses. Unauthorized debits and payments in RTGS that were not agreed upon by customers.

Clients also complained that Volo would not remit funds it received on behalf of its clients and that it did not maintain proper accounting records. In one case, Vuolo allegedly sold her client’s property twice resulting in $15,000 in damages to one of the buyers.

Efforts to get a comment from Fulu were futile as her number was continuously unreachable.

The Mirror then spoke to curator Funani Majoko who is now handling Folu’s pending cases. He said it was unfortunate that some people did not know these procedures.

“I have received complaints and I will finalize my report as soon as it is complete and LSZ will take appropriate action. They should not think that I want to hide evidence before the matter is finalized.”

Richard Chidza, director of corporate communications for the Law Society of Zimbabwe, said the law firm was under investigation and was currently under the supervision of its trustee. “The law firm is under guard and investigations are still ongoing. We will provide you with the details once they are completed,” said Chidza.

Getrude Tshabalala from Riverside Bulawayo complained that she had contracted with Volo to transport the goods
In exchange for 10 plots of land owned by her and her three children; Leonard, Lynette and Lloyd Tsabalala. The conspiracies were valued at $245,000 and were allegedly biased by false documents provided by counsel, concealment of important information, failure to provide complete statements of accounts, and failure to provide.

Tshabalala said she complained that Phulu had failed to submit documents for payment of the US$55,000 she paid Mr Sithole for land service in the form of road construction and water supply.

Tshabala had complaints about all 10 plots of land that Fulu sold on her behalf.

Netsai Magunda complained to the Law Society that in 2017 she and her brother Kutamahufa engaged Phulu to prepare a sale agreement for a property they wanted to buy
Ward 153 and 154 Machyumhope Bulawayo. After signing the sale agreement, they only realized in 2019 that Phulu had transferred the property into someone else’s name.

Magonda allegedly failed to recover US$15,750. Viola Chagweka complained that she had hired Fulu to carry out the appeal case before the Supreme Court. Phulu demanded payment in advance within four days and this was done. After serving other parties, the Supreme Court allegedly asked her to submit a copy under the seal of the Supreme Court, and that is when Chagweka realized that Phulu had not served the Supreme Court.

In May 2021, Vuolo filed a request with the chamber to reinstate the expunged case. She allegedly did not give Chaguica reasons for canceling the order.

It is alleged that Chagweka later realized that Folu had been suspended and her company had been placed under judicial administration and Magoko of Magoko and Majoko were made responsible for all of Folo’s clients. In 2018, Ntsai Magonda said she engaged Fulu over a relative’s property that was up for auction. They wanted Volo to save the property,

The property has been taken into private treaty with the expectation that the complainant will obtain a buyer.

Magonda and her relatives were surprised to learn that Geomoses Investments was the highest bidder and acquired the property for $180,000 RTGS. Records at the Registrar of Deeds allegedly indicate that the said company does not exist.

The value of the property reached 250 thousand US dollars.

In her statement to the Law Society, Magonda said she suspected Folu of acting in collusion to sell the property. Masvingo mirror
